Two accused of ID theft

Thursday, July 7th, 2011

A Texas Department of Public Safety agent on Friday afternoon arrested two people accused of creating counterfeit IDs to gain employment and rent a car, officials said.

Mike Padilla Jr., 36, is being held in Bexar County Jail on charges of forgery, theft of service, theft of check, resisting arrest, fraudulent use or possession of ID information and tampering with a government record. A judge set bail at $19,700 total.

Maria Guadalupe Padilla, 40, was released after posting $20,000 bail on charges of making or possessing a counterfeit insurance document, theft of service, fraudulent use or possession of ID information and tampering with a government record.

It was not immediately clear how or if the two people are related, but public records show they live at the same address. Arrest warrant affidavits state the same DPS agent investigated charges on both people.

In December, Maria Padilla reportedly rented a vehicle from Enterprise Rent-A-Car using what authorities later determined was a counterfeit Texas Driver License Temporary Permit, the affidavit states.

The identification number was found to belong to someone else, according to officials. She also provided insurance information for a policy that expired in June, the affidavit states, and then failed to return the vehicle. It was reported stolen to the Leon Valley Police Department and was recovered in May, officials said.

Mike Padilla Jr. is accused of using his father’s identity to get a job at a medical clinic. In January, he used his father’s social security number and date of birth on at least two forms, the affidavit states, including a counterfeit Texas Driver License Temporary Permit.

Both people were arrested around 3:40 p.m. Friday, records show.

The U.S. Supreme Court on Monday refused to hear the appeal of  a San Antonio woman who was sued for illegally downloading music through the internet when she was a teenager.  Justice Samuel Alito dissented, encouraging the court to hear the appeal that Whitney Harper now 22 filed in May after the lower court sided with the music industry

But he was alone in his opinion.  Harper must pay $27, 750 to the music companies or $750 for each of the 37 copyrighted songs she accessed through Kazaa and similar file sharing sites when she was 16.
