Traffic Stop Yields Drug Bust

Bexar County deputies found 420 pounds of marijuana in a car Thursday after they stopped its driver for speeding and running stop signs.

According to a news release a car driven by Joe Rocha was stopped near Culebra and Grissom roads and deputies found several duffel bags in the back seat containing 420 pounds of marijuana.

Lt Darrell Sanders said evidence in the car led deputies to a second car that drove through the area a short time later.

All of the passengers were arrested on charges of narcotics possession.  All the men posted bail and were released from Bexar County Jail.  Deputies seized the two vehicles in addition to the drugs.

Zavala County JP facing pot charge

When Zavala County Justice of the Peace Josie Gomez stepped down after being reprimanded by the State Commission on Judicial Conduct in 2007, the job stayed within the politically connected family.

Her son, Xavier R. Espinosa, now 31, was appointed by the Zavala County Commission to serve the rest of her unexpired term and he later won an election. The job pays $23,726 a year.

But now, he also is in legal hot water, facing a misdemeanor drug charge in Nueces County, and questions are being raised in Crystal City about how big a role local politics played in his appointment.

In March, Espinosa was charged with marijuana possession after a Corpus Christi policeman claims he saw Espinosa toss a baggie, containing less than two ounces of pot, from a car window. The case is set for trial on Aug. 29.

Contacted Thursday, Espinosa insisted the case has been dismissed.

“This is ridiculous. That was taken care of. It was thrown away,” he said.

“The thing is, I was in the vehicle, but it (the marijuana) wasn’t mine. It belonged to another person in the vehicle,” he added.

According to Nueces County court records, however, the charge is still pending.

Seana Willing, executive director of the judicial conduct commission, said even a conviction for this type of offense would likely not bring disciplinary action.

“The constitution provides you cannot hold public office if you are convicted of a felony, so an offense like a misdemeanor drug charge that doesn’t involve official misconduct would not trigger a disqualification,” she said.

“It’s not likely the commission would get involved unless someone filed a complaint or there was media coverage that cast attention on it,” she added.

The 2007 case involving Espinosa’s mother was more serious.

After an investigation, the commission determined that Josie Gomez, in finding Crystal City policeman Erasmo Ramon guilty of assault, had “demonstrated a fundamental lack of professional competence in the law.”

The commission found that she had conducted her own investigation, met privately with witnesses, failed to advise the defendant of his rights, and found him guilty even though no evidence was presented by a prosecutor.

Gomez resigned after being issued a public admonition and being ordered to take eight hours of judicial education and attend several trials to learn the judicial ropes.

Her son was among several people who sought the job, and he readily admits his resume was thin.

“I was a student. I still am. When I got appointed, I got no qualifications,” he said.

But Espinosa was the best candidate available, recalled County Judge Joe Luna, who said he only recently became aware of the marijuana charge.

“I’ve got to get an opinion on what steps we need to take. There is a presumption of innocence. We’ll have to let the criminal justice system take its course,” he said.

“Up until this point, there haven’t been any issues with him. He’s really been doing his job. He’s been attending seminars and training they provide for justices of the peace,” he added.

Firefighter facing drug charges

Ben David Haygood, 39, was charged with felony possession of a
controlled substance and three misdemeanors, according to authorities and an
arrest affidavit, after a traffic stop in West Lake Hills.

Haygood is a firefighter for the Austin Fire Department, said spokesman
Michelle DeCrane. The department has begun an investigation into the incident,
she said.

Haygood was arrested shortly after midnight near Bee Cave Road and
WestbankDrive, the affidavit said. A West Lake Hills police officer saw Haygood driving a Ford truck without tail or brake lamps or a rear license plate, the affidavit said. The officer said he arrested Haygood after finding that he had an outstanding warrant, the affidavit said.

The warrant from June 2010 was on a misdemeanor charge of theft by check, Travis County spokesman Roger Wade said.

The affidavit said that during the stop, officers found less than an ounce
of marijuana and two pills, described as amphetamine and dextroamphetamine, for which he did not have a prescription, in Haygood’s truck.

Haygood also was charged with misdemeanor possession of marijuana
and possession of drug paraphernalia, Wade said. Haygood was booked and
released Saturday from the Travis County Jail, Wade said.

Man Gets 20 Years For Fatal Mistake

A San Antonio man was sentenced to 20 years in prison Tuesday for killing the wrong person while trying to settle a score over a $1,300 marijuana deal gone bad.

Police said Leonard Perez Jr., 22, went to the Hunter’s Glen apartments on the Northwest Side in October 2009 looking for someone known as “Worm” who had ripped off either him or an associate.

Steven Craig Jones, 41, who went by the nickname “Psycho,” answered the door instead and said he did not know who “Worm” was, court documents state.

Perez kicked in the door and began firing, according to witness statements.

Jones died with seven gunshot wounds.  Another person in the home, Roderick Dancy, was shot in the buttocks but survived.

Perez pleaded no contest last month to murder in exchange for a maximum sentence of 30 years in prison.  On Tuesday, however, he proclaimed his innocence and asked State District Judge Mary Roman to rescind his plea.  She declined the request.

In a long complaint to the judge, the defendant’s father, Leonard Perez Sr., said his son had been bullied into pleading no contest after prosecutors threatened to arrest the defendant’s brother for allegedly disposing of the murder weapon.

“What kind of scare tactic is that? Gestapo tactics?” Perez Sr. asked.

Roman dismissed the allegations of prosecutorial misconduct, telling Assistant District Attorney Julie Wright: “I know you don’t threaten people for the sake of threatening them.  I know better.”

Charges against the brother would have been “highly appropriate” but would not be pursued because of the plea agreement, Wright said.

Outside the courtroom, defense attorney Mick Aguilera said his client had been nervous about the possibility of a 30-year sentence but was satisfied with what the judge gave him.

“Fortunately, the family didn’t lose two kids over this,” Aguilera said, adding that his client grew up in the gang system.  “Fortunately, his brother is not in the system and we can only pray he listens and becomes a better citizen as a result of this.”

No one from the victim’s family was able to attend the sentencing hearing.  Originally from Los Angeles, Jones had two children who miss him dearly, his sister told court officials by phone.

6 Tons Of Pot Seized in Valley

In Brownsville Texas, U.S. customs enforcement investigators found more than 6 tons of marijuana with an estimated street value of more than $11 million in a storage unit in Hidalgo county ICE said.  The pot was found on a tip that the unit was being used to repackage and distribute drugs.  Agents entered the unit on a search warrant Friday after a drug sniffing dog reacted.  They found 20 produce boxes containing 13,314 pounds of marijuana, as well as a roll of tape.  They also seized three assault rifles and two shotguns. 

In other seizures reported by ICE, border patrol agents seized 7,000 pounds of marijuana taken in recent days, including more than a ton seized from a pickup and abandoned house in Fronton Texas
