The child was hurt so badly that doctors feared he was trying to kill her. A member of the Texas National guard has been sentenced to 10 years in prison for injuring his girlfriends young child so severly that doctors at one point speculated he was trying to kill her.

Bailey was initially charged with intentionally causing serious bodily degree felony punishable by up to life in prison. As part of a plea bargain in May he instead pleaded guilty to reckless injury and prosecutors agreed to ask for no more than 15 years in prison.

Abuse Suspected In Newborn Death

San Antonio police arrested a man suspected of abusing his newborn baby, who died early Sunday morning at a West Side home. Justin Janosik, was set to be booked in Bexar County Jail on one count of Injury to a child causing serious bodily injury with intent.

A judge set bail at $100,000. The bexar county medical examiner’s office has not yet completed an autopsy to determine how 2 week old Kaleb Janosik died, but police reported noticing bruises above his eye on his neck and his back.

Child abuse is a very serious crime, but when the abused child dies the entire situation jumps to a new level. Instead of facing probation or a short prison sentence now the parents are facing felony child abuse charges if not felony manslaughter.

Dad Charged In Tot’s Drowning In Tub

The father of a developmentally disabled 3-year-old girl who drowned in her family’s bathtub has been charged with injury to a child causing serious bodily injury, a first-degree felony.

Christopher Hopkins, 29, posted $50,000 bail and was released early Tuesday, according to Bexar County Jail records.

He and his wife had been the subject of an ongoing neglect investigation launched by Child Protective Services three months before the death of Cassie Hopkins on March 12.

He was arrested Monday night. Hopkins acknowledged he left the child-who had Angelman syndrome, a form of palsy, and who was unable to walk or talk-alone in a tub with the water running while he watched a pornographic video in another room, an arrest warrant affidavit states. He said he had checked on her 10 minutes before returning and finding her unresponsive.

The Bexar County medical examiner ruled the girl’s death was an accident.

The affidavit states CPS caseworkers had an active investigation involving the family, which agency spokeswoman Mary Walker confirmed Tuesday.

The couple’s other four children were removed from the household after a hearing March 17, five days after the child’s death, Walker said.

At a hearing set for March 30, the agency plans to ask a judge to continue the order keeping the children, aged 12, 9, 7 and 4, in state custody.

Fugitive From S.A. Nabbed At Border

A fugitive from San Antonio trying to slip into Mexico on his birthday was caught by federal officers Thursday in Eagle Pass.

Gerardo Lopez Castillo, 44, a Mexican citizen who was living in San Antonio, was stopped by U.S. Customs and Border Protection officers and Border Patrol agents as he tried to walk across the international bridge from Eagle Pass to Piedras Negras, Mexico.

The officials determined that Lopez Castillo was wanted in San Antonio on three counts of aggravated sexual assault of a child, according to a news release.

Lopez Castillo was at Maverick County Jail on Tuesday evening awaiting extradition to Bexar County.

Boyfriend Jailed In Infant’s Death

Poteet police have arrested a man in the death of his girlfriend’s infant son, the town’s first homicide since 2004, the police chief said.

Jeromy de la Garza, 28, was charged with capital murder Thursday. He remains at Atascosa County Jail, with bail set at $1 million.

Poteet police Chief John Overstreet said officials at South Texas Regional Medical Center in Jourdanton called the police department on February 22 to report a possible case of injury to a child.

Six-month-old Tarron Eagle was airlifted to University Hospital, where he died the next morning. The Bexar County medical examiner’s office reported he had suffered blunt force trauma to the head, Overstreet said.

The Chief said he could release few details about the case, an ongoing investigation involving the Texas Rangers as well as Poteet.

Officials believe the injury took place at the Crestview Apartments in Poteet, where de la Garza lived with Tarron’s mother. She has lived in the area about a year and has dated de la Garza, who is not Tarron’s father, for six months, Overstreet said.

A toddler living in the home, also belonging to Tarron’s mother, is in the custody of Child Protective Services, Overstreet said.

Man Accused Of Injuring Baby

A man remained in Bexar County Jail on Monday after his weekend arrest on charges he injured a 1 year old boy. Benjamin barcenas was ordered held on $50k bail, accused of injuring the son of his girlfriend two weeks ago. The infant, whom Barcenas was watching while the childs mother worked, suffered a broken leg and had previously had both right and left collar bones fractured, according to an arrest warrant affidavit..

Couples charged In Boy’s Death

A couple were arrested Wednesday on suspicion of injury to a child by omission in the death of a 3 year old boy last year. Janie Altamirano and her boyfriend Michael Pastran both 23 are accused of not providing adequate medical care for Altamirano’s son Ethan before his death Dec 6 police report Ethan was struck on his abdomen and back before he was found unresponsive at a West Side home.

Altamirano told police that Ethan was vomiting the two days before he died. She said she called a nursing hotline and planned to take him to the doctor. But the cause of death was ruled blunt force trauma. As police led Altamirano to a patrol car, she told reporters she had nothing to do with Ethan’s death. Pastran didn’t comment. Child protective services has custody of Altamirano’s two other children.

Boy Scouts Sued Over Molestation

A Converse teen whose former assistant Scoutmaster is serving a 60 year prison term for child molestation filed a lawsuit Wednesday against the Boy Scouts of America and its local affiliate.

James Hiatt, 30 was convicted by a Bexar County jury in 2008 of four counts of aggravated sexual assault of a child and five counts of indecency with a chld stemming from interactions with the boy in 2004 and 2005. Abuse is and has always been unacceptable and the Boy Scouts of America extends its sympathies to the victims.

During the suit, the attorneys said they discovered more than 20,000 pages of internal Boy Scouts documents regarding child abuse concerns with in the organization.

ABANDONING OR ENDANGERING CHILD

Sec. 22.041. ABANDONING OR ENDANGERING CHILD. (a) In this section, “abandon” means to leave a child in any place without providing reasonable and necessary care for the child, under circumstances under which no reasonable, similarly situated adult would leave a child of that age and ability.

(b) A person commits an offense if, having custody, care, or control of a child younger than 15 years, he intentionally abandons the child in any place under circumstances that expose the child to an unreasonable risk of harm.

(c) A person commits an offense if he intentionally, knowingly, recklessly, or with criminal negligence, by act or omission, engages in conduct that places a child younger than 15 years in imminent danger of death, bodily injury, or physical or mental impairment.

(c-1) For purposes of Subsection (c), it is presumed that a person engaged in conduct that places a child in imminent danger of death, bodily injury, or physical or mental impairment if:

(1) the person manufactured, possessed, or in any way introduced into the body of any person the controlled substance methamphetamine in the presence of the child;

(2) the person’s conduct related to the proximity or accessibility of the controlled substance methamphetamine to the child and an analysis of a specimen of the child’s blood, urine, or other bodily substance indicates the presence of methamphetamine in the child’s body; or

(3) the person injected, ingested, inhaled, or otherwise introduced a controlled substance listed in Penalty Group 1, Section 481.102, Health and Safety Code, into the human body when the person was not in lawful possession of the substance as defined by Section 481.002(24) of that code.

(d) Except as provided by Subsection (e), an offense under Subsection (b) is:

(1) a state jail felony if the actor abandoned the child with intent to return for the child; or

(2) a felony of the third degree if the actor abandoned the child without intent to return for the child.

(e) An offense under Subsection (b) is a felony of the second degree if the actor abandons the child under circumstances that a reasonable person would believe would place the child in imminent danger of death, bodily injury, or physical or mental impairment.

(f) An offense under Subsection (c) is a state jail felony.

(g) It is a defense to prosecution under Subsection (c) that the act or omission enables the child to practice for or participate in an organized athletic event and that appropriate safety equipment and procedures are employed in the event.

(h) It is an exception to the application of this section that the actor voluntarily delivered the child to a designated emergency infant care provider under Section 262.302, Family Code.

Tongue Hurt When Boy Sticks It Out

When a teenager stuck his tongue out at his mother’s boyfriend while the couple argued friday night, the man grabbed the boy’s tongue and pulled it, injuring the boy according to San Antonio Police. Chadwick Benoit, was still in Bexar county jail on Monday, charged with injury to a child. A judge set bail at $5,000. officer matthew porter, a police spokeswoman wouldn’t say where the alleged incident took place. The boy 12 stood between the couple as they argued, porter said and stuck out his tongue. Benoit’s actions caused pain and injury, when benoit fell asleep after the incident his girlfriend called 911.
